Costs of arbitration / Apportionment of costs

'Claimant succeeds in this arbitration on the principle of some of its claims, but is granted only slightly more than one-tenth of its initial monetary claims. On the other hand, all counterclaims filed by Respondent are rejected.

Taking into consideration the particularities of this case, the attitudes of the parties, and the difficulty to bring satisfactory evidence on some of the claims, the Arbitral Tribunal considers it fair that each party should bear its own cost and share equally the direct cost of this arbitration proceedings (arbitrators' fees and expenses and ICC's administrative cost).'
